Terms of Service
The agreement between you and KACHAK SPACE INNOVATION when you host or join a space. Written to be read; it is not legal advice, and where it is unclear the plain meaning is the one intended.
Who you are dealing with
Kachak is operated by KACHAK SPACE INNOVATION, a sole proprietorship registered in Malaysia under SSM registration 202603188421 (KT0617814-H), of Kuala Lumpur. Reach us at hello@kachak-app.com.
What the service is
A host buys a space for one event. Guests join it free, everyone gets a limited roll of shots, and the photos collect into one gallery shared by the members of that space and nobody else. A space is open for five days from creation; its photos remain viewable for sixty days after it closes, and are then deleted. That expiry is part of what is being sold, not a fault.
Paying
One payment per space, at the price shown for the number of people chosen. There is no subscription and nothing recurring.
Who takes the payment depends on where you buy. A space bought inside the iPhone or Android app is sold by Apple's App Store or by Google Play, at the price they show you and under their terms. A space bought on this website is sold by us, in Malaysian ringgit, and processed by HitPay. We never see or store your card details either way. A space exists once the payment is confirmed — if a payment succeeds and no space appears, tell us and we will create it or refund you, whichever you prefer.
Refunds
A space that no guest has joined and in which no photo has been taken can be refunded within 7 days of purchase. Write to hello@kachak-app.com with the event name. Once guests have joined and begun shooting, the space has been delivered — the roll belongs to the room by then — and it is not refundable.
Who refunds you depends on how you paid. A purchase made inside the app is taken by the App Store or Google Play, and only they can return it — ask them, not us; we are not told when they do. A purchase made on this website is ours to refund and we process it through HitPay.
For a website purchase, what the payment rails can actually do: card and FPX come back in 3–5 business days, Touch ’n Go can take 7–14. DuitNow QR cannot be reversed the way it was paid — the rail does not support it — so we return that by bank transfer instead. The processor's original transaction fee is not returned to us, so it is not part of what comes back to you.
This does not affect any right you have under Malaysian consumer law.
Your photos stay yours
You own the photos you take. You give us only the permission the product needs to work: to store your photos and show them to the members of the space you took them in, for as long as that space exists. We do not use your photos for advertising, we do not use them to train models, and we do not show them outside their space.
How old you have to be
Kachak is for people aged 18 and over. Hosting a space is a paid agreement, and we have no way to take a parent or guardian's consent, so we do not offer the app to anyone younger.
Shooting responsibly
We have zero tolerance for objectionable content and for abusive users. Photograph people who are happy to be photographed. Do not use Kachak for anything unlawful, for material that sexualises children, for nudity or sexual content, for violence or gore, for hate or harassment, or to photograph people without their knowledge where they would expect privacy. We remove content, block people and close spaces that break this, and we cooperate with lawful requests from the authorities.
Screening. A cover is the one image that leaves the gallery — it goes on the invite, the printed poster and the share card — so every cover is screened automatically the moment it is set. One that comes back adult or violent is taken down, the space falls back to the emoji it already has, and a report is filed for a person to read. Anything a member reports is screened the same way before that person opens it.
Reporting. Report anything that breaks these rules from inside the app — open the photo and choose Report, or report the person from the guest list. The host of a space can also take a frame down themselves. We read every report within 24 hours and remove what should not be there; where someone did it deliberately, their access goes with it. Reports do not tell the person who filed them. You can also write to hello@kachak-app.com, which is the same inbox.
Blocking. You never have to wait for us to stop seeing someone. Block them from their photo or from the guest list and their frames and their face leave the space for you immediately, no matter whose space it is. Profile → Blocked people lists everyone you have blocked, and unblocks them again.
Hosts are responsible for who they invite. A join code is a key to the gallery, so give it to the room and not to the internet.
Accounts and deletion
You can delete your account from inside the app at any time: Profile → Delete account. That removes your account, profile, rewards and referral code, and takes your name off every space you joined. Photos you took stay in the spaces they were shot for — they belong to that event too — and so do spaces you hosted, because other people are in them; both vanish on their own schedule. Nobody deletes their own frames — that is what keeps a roll honest — so if a photo should not be there, report it or ask the space's host, who can remove any frame in their own space.
What we do not promise
We will keep the service running and your photos safe with the care you would expect, but we cannot promise the service is uninterrupted or error-free, and a phone, a network or a payment gateway can fail in ways we do not control. If we are liable to you for something, our liability is limited to what you paid for the space in question. Nothing here limits liability that cannot be limited by law.
Changes
If we change these terms we will update this page and the date below. A change never applies retroactively to a space you have already paid for.
Law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction.
