Terms of Service
The agreement between you and KACHAK SPACE INNOVATION when you host or join a space. Written to be read; it is not legal advice, and where it is unclear the plain meaning is the one intended.
Who you are dealing with
Kachak is operated by KACHAK SPACE INNOVATION, a sole proprietorship registered in Malaysia under SSM registration 202603188421 (KT0617814-H), of Kuala Lumpur. Reach us at kachak.test@gmail.com.
What the service is
A host buys a space for one event. Guests join it free, everyone gets a limited roll of shots, and the photos collect into one gallery shared by the members of that space and nobody else. A space is open for five days from creation; its photos remain viewable for sixty days after it closes, and are then deleted. That expiry is part of what is being sold, not a fault.
Paying
One payment per space, at the price shown for the guest capacity chosen, in Malaysian ringgit. There is no subscription and nothing recurring. Payments are processed by HitPay; we never see or store your card details. A space exists once the payment is confirmed — if a payment succeeds and no space appears, tell us and we will create it or refund you, whichever you prefer.
Refunds
A space that no guest has joined and in which no photo has been taken can be refunded in full within 7 days of purchase. Write to kachak.test@gmail.com with the event name. Once guests have joined and begun shooting, the space has been delivered — the roll belongs to the room by then — and it is not refundable.
This does not affect any right you have under Malaysian consumer law.
Your photos stay yours
You own the photos you take. You give us only the permission the product needs to work: to store your photos and show them to the members of the space you took them in, for as long as that space exists. We do not use your photos for advertising, we do not use them to train models, and we do not show them outside their space.
Shooting responsibly
Photograph people who are happy to be photographed. Do not use Kachak for anything unlawful, for material that sexualises children, for harassment, or to photograph people without their knowledge where they would expect privacy. We will remove content and close spaces that break this, and we will cooperate with lawful requests from the authorities.
Hosts are responsible for who they invite. A join code is a key to the gallery, so give it to the room and not to the internet.
Accounts and deletion
You can delete your account from inside the app at any time: Profile → Delete account. That removes your account, profile, rewards and referral code, and takes your name off every space you joined. Photos you took stay in the spaces they were shot for — they belong to that event too — and so do spaces you hosted, because other people are in them; both vanish on their own schedule. Delete any photos you want gone before you delete your account.
What we do not promise
We will keep the service running and your photos safe with the care you would expect, but we cannot promise the service is uninterrupted or error-free, and a phone, a network or a payment gateway can fail in ways we do not control. If we are liable to you for something, our liability is limited to what you paid for the space in question. Nothing here limits liability that cannot be limited by law.
Changes
If we change these terms we will update this page and the date below. A change never applies retroactively to a space you have already paid for.
Law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction.
